FCC General Terms and Conditions
Article 1 - Definitions
1. In these general terms and conditions, the following terms are used in the following meaning, unless expressly stated otherwise:
2. Offer: Any written offer to the Customer for the delivery of Products by Felicias Frequency to which these conditions are inextricably linked.
3. Company: The natural or legal person acting in the exercise of a profession or business.
4. Consumer: The natural person who does not act in the exercise of a profession or business.
5. Digital Products or Services: The Products or Services offered by Felicias Frequency.
6 Felicias Frequency: The provider of Products/Services to the Customer.
7. Customer: the Consumer or Company who purchases a service or product.
Article 2 - Applicability
1. These general terms and conditions apply to every Offer from Felicias Frequency.
2. Before a (distance) Agreement is concluded, the Customer will be provided with these general terms and conditions. If this is not reasonably possible, Felicias Frequency will indicate to the Customer how the Customer can view the general terms and conditions. The customer must also agree to the general terms and conditions when purchasing a product or service.
3. These general terms and conditions also apply to additional, amended and follow-up orders from the Customer.
4. If one or more provisions of these general terms and conditions are partially or completely null and void or are annulled, the other provisions of these general terms and conditions will remain in force and the void/nullified provision(s) will be replaced by a provision with the same effect as the original provision.
Article 3 - Dissolution
1. All services and/or products offered by Felicias Frequency can be purchased online. After purchase, there is no possibility of a refund, unless you are unable to attend an offline retreat due to the death of your first degree. If you are ill, we also ask you to stay at home. If you are ill, you can keep the costs and cash them in later. In the event of death, the exception is that you will receive a refund.
2. Felicias Frequency is only bound to an Offer if the Customer has already paid the amount due. Nevertheless, Felicias Frequency has the right to refuse an Agreement with a (potential) Customer for a reason justified by Felicias Frequency. If we reasonably believe that we can no longer properly guide you as a coach, we may terminate an assignment prematurely without having to observe a notice period.
3. The Offer contains an accurate description of the digital Product or Service offered with associated prices. The description is sufficiently detailed so that the Customer is able to make a good assessment of the Offer. Obvious mistakes or errors in the Offer cannot bind the provider. All information in the Offer is only an indication and cannot be a ground for any compensation or termination of the Agreement (remotely).
4. Offers or quotations do not automatically apply to follow-up orders. A new offer and quotation is made for each follow-up order.
Article 4 – Services and products:
1. Both Customers, being consumers, and Customers, being companies, can participate in Felicias Frequency's coaching, retreats and digital products.
2. The provider (Felicias Frequency) has the right at any time to change, expand or no longer offer the mentioned products and services.
3. All current prices and content of the digital products are subject to change. The provider also reserves the right to change the offer with regard to the price.
Article 5 – Membership 1. The membership is valid for 12 months and has a notice period of 6 months.
2. You get access to the community, i.e. all services offered on the site that fall under the membership. You can always use your unique membership code for this.
3. Early termination of the Membership is not possible. The sole reason that the Customer does not use the content of the membership does not entitle the Customer to a refund of the amount paid. You remain responsible for your purchase. You can, however, transfer your purchase to someone else. Please inform us about this and we will arrange this administratively with the following legal entity.
4. Customer, being a consumer who has agreed to the general terms and conditions, automatically waives their right of withdrawal. Since participation in the Membership involves direct access to digital products, refunds are not possible. Due to possible copies and other unforeseen circumstances.
5. After the Membership ends, Felicias Frequency will make a new offer to the Customer by e-mail. Customers are also asked what they thought of the membership and whether they would like to leave a review.
Article 6 – 1:1 Coaching
1. This article serves as a detailed explanation of the content of the '1:1 Coaching' of Felicias Frequency
2. 1:1 coaching means the personal guidance and coaching of the Customer, not in a group context.
3. Information about the duration, number of sessions and other house rules will be provided by the provider to the Customer at the same time as the offer.
4. The advice provided by Felicias Frequency, in whatever form, can never be regarded as binding advice.
5. Felicias Frequency is not available for support outside of coaching sessions. You can purchase an extra subscription for support to get extra coaching hours.
6. Appointments already made for one-off one-on-one coaching, which are canceled 24 hours before the start date of the appointment, will be charged 100% of the agreed fee. In case of cancellation, a new appointment can be scheduled, which must be scheduled within two months of the canceled session. If the follow-up coaching session is scheduled after these two months, the Customer must schedule a new appointment in accordance with Eurshanie's rate.
7. If the Customer is not satisfied with the services or coaching provided by Felicias Frequency, the Customer must email Felicias Frequency in a timely manner via an official notice of default. The provider has 14 days to respond substantively and to remedy any breach of contract.
Article 8 - Conclusion of the Agreement
1. The Agreement is concluded when the Customer has accepted an Offer from Felicias Frequeny by paying for the relevant Product or Service via the designated payment service, after which the Customer will in turn gain access to the relevant Service.
2. An Offer can be made by Felicias Frequencty via the website, social media, e-mail and other digital platforms.
Article 10 - Expectations of the Agreement
Article 20 What can you expect from us?10.1 We offer you tools and support to get the best out of yourself and your business and will provide our services carefully and to the best of our knowledge and ability.10.2 Our offer is aimed at helping you to to become a successful entrepreneur. But you always remain responsible for your own transformation and development. Success depends on your own commitment, motivation, learning ability and qualities.10.3 We emphatically do not provide any guarantees for achieving a specific (financial) result .Article 11. What do we expect from you?
11.1 You are motivated and actively committed to achieving the goals you have set. You make your own decisions and are responsible for them.11.2 You provide us, solicited and unsolicited, with all information that may be important for the execution of the agreement and inform us in a timely manner about changes.11.3 You act respectfully towards our team and other participants and takes their rights and privacy into account.11.4 During meetings you adhere to the applicable standards regarding public order, good morals and decency. You also adhere to the house rules that apply at the location and follow the directions and instructions given by us or third parties engaged by us.11.5 You respect our copyright. The material we make available to you, including audio, video and documentation, may only be used by you. You may not reproduce, disclose, share with third parties or exploit this material without our written permission. You may make a copy for your own use.11.6 You can communicate with other participants online. You declare not to send spam or otherwise unwanted communications. Commercial expressions are only permitted in designated areas or with our permission. We may delete your messages and responses without further notice if their content justifies their removal. 11.7 Making video or audio recordings during meetings (regardless of what form) is not permitted unless we have given prior written permission for this. Making recordings during an individual appointment is permitted provided you have informed us of this in advance. It is expressly prohibited to use these recordings for purposes other than personal use.11.8 You do not give the received access data for the online environment and the received license code to others and you do not allow others to use the online environment in any other way.11.9 Violating the members 3 to 8 by or on behalf of you may result in immediate exclusion from access to and use of our services. In that case, we may also remove you from a meeting. Exclusion or removal does not affect the obligation to pay the agreed fee for the relevant service.
The result of the Services and digital products always depends on the efforts of the Customer. Everyone is expected to actively participate in the Services and digital products. In addition to following the online program, 1:1 coaching or participating in the retreat, the customer is expected to reserve sufficient time for completing the assignments and implementing the information. promotional purposes.
Article 12 - Privacy, data processing and security
1.Felicias Frequency handles the (personal) data of the Customer and visitors to the website(s) with care. If there are any questions regarding the recording of Customer data, Felicias Frequency will inform the person concerned.
2. Felicias Frequency takes the Customer's privacy seriously and only uses personal data in the context of its services.
The provider adheres to the legal rules regarding the Protection of Personal Data.
Article 13 - Applicable law
1. Dutch law applies to the legal relationship between Felicias Frequency and the Customer. The applicability of the (CISG) Vienna Sales Convention is expressly excluded.
2. In the event of an explanation of the content and scope of these general terms and conditions, the Dutch text is always decisive. Felicias Frequency has the right to unilaterally change these general terms and conditions.
